IRS rule to bolster Obamacare under White House scrutiny (1)

A final rule to ensure IRS regulations comply with the Affordable Care Act’s “protect and strengthen policy” has been submitted to the White House Office of Management and Budget for review.

The rule would change Obamacare premium tax credit regulations to require that the “affordability” of company plans be based on the share of employees plus their family members. Current regulations require employers to provide affordable coverage based solely on the cost of the employee’s coverage.

A proposed rule (RIN 1545-BQ16) was released by the Internal Revenue Service in April.
