MORGAN CO., Alabama. (WAFF) – On Tuesday, lawyers for Preston Lamar Nelson filed a motion for a mental health evaluation to determine if he is fit to go to trial.
On August 19, Nelson allegedly backed up and ran over Sherry Stain in a Walmart neighborhood parking lot in Decatur. Stain was pronounced dead at the scene.
Nelson’s lawyers said that during the alleged offense, Nelson had a limited memory of the day and suffered from auditory and visual hallucinations.
The following statement is how the motion reads in terms of assisting Nelson through a trial:
“He does not have the ability to understand the proceedings of the trial or the consequences of the legal process. It is in the opinion of defense counsel that he is unable to assist in his criminal defence.”
Nelson remains in the Morgan County Jail on $500,000 bond.
